The Dutch Republic had a broad range of means to establish an individual's identity, and a rudimentary ‘system’ of identity registration, essentially established at the local levels of town and parish. This chapter seeks to provide a description of the ways in which the Dutch established an individual's identity. The various registration methods covered almost the entire population of the Dutch Republic at some stage in their life, and it is argued that on balance identity registration in the Dutch (...) Republic was fairly successful. The chapter contends that the degree to which identity was registered and monitored in the early modern era in the Netherlands, while certainly not wholly effective, is remarkable given the absence of a centralized state and the lack of a large bureaucracy. The Cerdanya valley in the eastern Pyrenees has a physical unity into which a political frontier has been imposed to divide it. The social and cultural repercussions of this Franco-Spanish border have created obstacles to marriage which are not due to topography. Choice of month of marriage is under cultural control and the study of seasonality in marriages recorded in the registers of all the Cerdan parishes on both sides of the border demonstrated differences over time and between French and (...) Spanish sectors. It is suggested that these changes demonstrate the process of distancing of the two populations. Cluster and correspondence analysis showed progressive differentiation of the seasonality patterns of the French and Spanish Cerdans despite the geographic unity of the valley. Photography is valued as a medium for recording and visually reproducing features of the world. I seek to challenge the view that photography is fundamentally a recording process and that every photograph is a record—a view that I claim is based on a ‘single-stage’ misconception of the process. I propose an alternative, ‘multi-stage’ account in which I argue that causal registration of light is not equivalent to recording and reproducing an image. Intervention or non-intervention by photographers is more sophisticated than (...) the traditional view allows. Using the multi-stage account, I describe four models for producing photographic images and pictures. (shrink)

In 1371 Edward III appealed to Parliament for a grant of taxation in order to support the war recently reopened against the French. The resulting lay subsidy, levied in each parish throughout the country and designed to contribute a total of £50,000 to the royal coffers, marked a change in the taxation procedures used in England since the 1330s and opened a period of experimentation which was to culminate in the three poll taxes of 1377, 1379, and 1380. It (...) has long been appreciated that the dramatic increase in royal financial demands in the 1370s, coinciding with the decline of English fortunes on the Continent, produced widespread disaffection in the country, which manifested itself in the Good Parliament of 1376 and the Peasants' Revolt of 1381. The 1371 Parliament and the tax which it granted therefore have much to tell us about the attitudes of political society in England to the military and domestic policies of the Crown during Edward III's last years. Machine vision is one of the main applications of artificial intelligence. In China, the machine vision industry makes up more than a third of the national AI market, and technologies like face recognition, object tracking and automated driving play a central role in surveillance systems and social governance projects relying on the large-scale collection and processing of sensor data. Like other novel articulations of technology and society, machine vision is defined, developed and explained by different actors through the work (...) of imagination. In this article, we draw on the concept of sociotechnical imaginaries to understand how Chinese companies represent machine vision. Through a qualitative multimodal analysis of the corporate websites of leading industry players, we identify a cohesive sociotechnical imaginary of machine vision, and explain how four distinct visual registers contribute to its articulation. These four registers, which we call computational abstraction, human–machine coordination, smooth everyday, and dashboard realism, allow Chinese tech companies to articulate their global ambitions and competitiveness through narrow and opaque representations of machine vision technologies. This study examines the Canadian Code of Ethics for Registered Nurses as a discursive mechanism for shaping nurses' professional identity using a Foucauldian lens. Nurses are considered essential in healthcare, yet the nursing profession has struggled to be recognized for its discipline‐specific knowledge and expertise and, as such, has remained the subject of and subject to the dominant discourses within healthcare and society generally. Developing a professional identity in nursing begins after the necessary education and training are achieved and (...) embodies the profession's history, values, code of ethics, and expectations of the profession that distinguish it from other professions. Since nurses' professional identity is shaped through discourse, it raises the question of whether there are spaces to reconceptualize nurses' subject position within health care. Since professional identity is considered the embodiment of knowledge and practice, the code of ethics bears examination both for its effect on nurses' professional identity and as a potential site from which to challenge hegemonic assumptions. This article discusses the concept of professional identity in nursing and its development through the discursive formations in the code of ethics. The sources of power/knowledge are examined as both mechanisms of control and as spaces for change. (shrink)

This paper explores essential characteristics of current nursing practice from the perspectives of clinically experienced registered nurses in various fields of health care in Sweden. Nursing practice has been the subject of much debate in the past and because of its complexity as well as continuous changes in society it is important to continue the debate. A qualitative study, including 16 group interviews with altogether 74 participants, was conducted. Nursing practice was viewed as a multifaceted field. The participants struggled (...) to define nursing but were able to describe it using concrete examples. The analysis, using interpretive description, identified current practice as essentially consisting of: ‘A practice pervaded by comprehensive responsibility’, ‘A practice that recognises a patient's unique needs’, ‘A practice based on multifaceted knowledge’ and ‘A practice that mediates between traditional values and changing demands’. Current nursing practice can be understood as striving to be in close proximity to the patient, but in tension with pervasive requirements and societal changes. Going forward, it is necessary to continue to reflect on and discuss the nature of nursing practice in an interprofessional context. Studies from primary and home care are also needed to broaden the understanding of nursing practice. (shrink)

If a state with liberal political and justificatory commitments extends benefits of various kinds to persons forming families, what qualifications may such a state place on the right to access to those benefits? I will make two assumptions for the purposes of this paper. The first is the political and justificatory terrain of some form of political or otherwise non-perfectionist liberalism. The assumption is that we are considering the resources and limitations of a community of persons who accept moral pluralism (...) (if not a specific doctrine like the "burdens of judgment"), some priority for individual freedom, and the obligation to justify public coercion and exclusion in terms accessible and fair to all members of morally and culturally diverse society. The second is that it is justified for a liberal state to recognize some forms of domestic partnerships or families in the first place and extend further benefits to them such as tax credits or laws extending (or facilitating the extension of) medical or social insurance. It is, of course, possible to imagine the argument that the liberal state gets out of the marriage business by getting out of it entirely - by extending no recognition or positive rights to families whatsoever beyond negative non-interference rights. I am interested in the dilemma of a society broadly like existing liberal ones which is committed both to subsidizing families and also to justificatory neutrality (expressed in American constitutional legal terms as the requirement of providing a "rational basis" for unequal treatment). Given these assumptions, I believe that the most justifiable policy on liberal grounds is not the institution of "marriage" increasingly open to new constituent relationships but rather a status of "registered domestic partnership" which fulfills the social and moral aims behind subsidizing the family but is entirely neutral not only to the gender or even to the numbers of the partners, but also to the affective and emotional content of domestic life and the purposes behind contracting domestic partnerships. So is there a right to polygamy and incestuous marriage? There is not a specific right to either and thus there is no a priori reason why some restrictions or even prohibitions on them might not be justified, but the same is true for every specific act where a general right to the freedom exists. I argue in this paper, however, that the arguments compatible with public reason for prohibiting them outright, or even for excluding them from the permissible types of legally registered partnerships, are quite weak. I argue that objections to polygamy from (1) female autonomy, (2) damage to children, (3) fairness in the marital market, and (4) the unfair burdening of society are serious and worth refuting, but do not establish a victorious case against multi-member relationships. As to incest, there are two separate questions. The first is whether the new institution of "registered domestic partnerships" should be open to them. The answer to that, given the state's lack of interest in citizens' reasons for forming partnerships and in what they do whilst being registered in one, is clearly "yes." The second is whether, entirely separate from the issue of legal recognition of domestic partnership, the state has a legitimate rational interest in deterring, preventing or punishing consanguineous sexual relations between close blood relations (first-degree incest). Here, the objections to allowing such relations are those from (1) child abuse; (2) unfair burdening of society; and (3) the creation of bad lives. I argue that while rape and other forms of child abuse would be no more legal or tolerated than they are now, the concern about any form of weakening a society's legal and political resources to combat such abuses does indeed register on the justificatory scale, but does not prove that such first-degree incestuous sexual relations are inherently bad enough to warrant intervention. I then argue that the concern about unfairly burdening society with unhealthy persons is not as dangerously totalitarian as we might initially fear, but nor is it strong enough to justify an outright prohibition. Finally, I argue that a concern to dissuade persons from creating certain kinds of lives (children with extreme birth defects) is also not as dangerously totalitarian as we might initially fear, and in fact goes further towards explaining why we might have a legitimate interest in intervening. Nonetheless, I argue that the criminalization of such acts only make sense when they are indicators of other offenses, namely negligence or abuse, and it thus seems that the act of consanguineous reproduction is itself insufficient. Blacks and Puerto Ricans, already scrambling for the few available jobs society provided for them, squared off against each other. Police and the city of New York vowed more punishment, more arrests. (At this same time, Leonard Bernstein portrayed these struggles in terms of the love of Tony and Maria, but in "real life" it was "East Side Story" as much as "West Side Story.")In response to renewed war among his youth, the Episcopal priest, Fr. Kilmer Myers of St. Augustine's Chapel (now St. Augustine's Parish) also took to the streets. Canceling the church's usual patronal festival and carnival, he led his people in a procession through the streets of his neighborhood, with clergy clad in the solemn vestments of the Eucharist, with banners, incense, and hymns. I submit the need to establish a comparative study of societies, namely groups beyond a simple, immediate family that have the potential to endure for generations, whose constituent individuals recognize one another as members, and that maintain control over access to a physical space. This definition, with refinements and ramifications I explore, serves for cross-disciplinary research since it applies not just to nations but to diverse hunter-gatherer and tribal groups with a pedigree that likely traces back to the societies of (...) our common ancestor with the chimpanzees. It also applies to groups among other species for which comparison to humans can be instructive. Notably, it describes societies in terms of shared group identification rather than social interactions. An expansive treatment of the topic is overdue given that the concept of a society (even the use of such synonyms as primate “troop”) has fallen out of favor among biologists, resulting in a semantic mess; while sociologists rarely consider societies beyond nations, and social psychologists predominantly focus on ethnicities and other component groups of societies. I examine the relevance of societies across realms of inquiry, discussing the ways member recognition is achieved; how societies compare to other organizational tiers; and their permeability, territoriality, relation to social networks and kinship, and impermanence. We have diverged from our ancestors in generating numerous affiliations within and between societies while straining the expectation of society memberships by assimilating diverse populations. Nevertheless, if, as I propose, societies were the first, and thereafter the primary, groups of prehistory, how we came to register society boundaries may be foundational to all human “groupiness.” A discipline-spanning approach to societies should further our understanding of what keeps societies together and what tear them apart. Human society is unique in the animal kingdom in the degree to which it depends upon its members reflective awareness of self and society. Whereas much has been learned about the sense of self, little is known about the sense of society. This paper develops three points about the human sense of society: First, this sense is a feeling of life, what German writers have called Lebensgefuhl. The paper begins by defining feeling as a psychical moment (...) or‘phase’of bodily activity. The paper later develops die idea mat what is felt of society is always an embodiment of its vital form; its social life. Second, die sense of society is a feeling of society, as distinct from a feeling in society and from a feeling of self. The middle third of die paper distinguishes these concepts and links die feeling of society to writings of Freud and Durkheim in which elements of this feeling are found. And third, feelings of society prominently include participation, love, and play. These feelings, which are embodiments of vital social form, are illustrated and discussed in die penultimate section of die paper. Having registered these three points, die paper concludes with a brief summary and discussion of implications for expanding die scope of inquiry in social science. (shrink)

The theme is construed to embrace the following four areas of investigation: Hegel's philosophies of nature and the sciences within the context of his philosophy as a hole and the thought of his time, implications of Hegel's philosophies of nature and the sciences for understanding other aspects of his philosophy, the relation of Hegel's thought and method of relating to the sciences to developments and issues in the sciences and the philosophy of science since his time, and the contributions of philosophers who in some identifiable way have practiced Hegel's method or style of doing philosophy as these relate to the sciences or to the philosophy of science since his time. The scope of the theme may be modified, et the discretion of the Committee on Arrangements, to accommodate a promising paper. We commonly explain the distinctive prudential and moral status of persons in terms of our mental capacities. I draw from recent work to argue that the common explanation is incomplete. I then develop a new explanation: We are ethically important because we are the object of a pattern of self-concern. I argue that the view solves moral problems posed by permissive ontologies, such as the recent personite problem.

In this paper, I summarize and object to the “deep-self” view of moral responsibility as laid out by Susan Wolf in “Sanity and the Metaphysics of Responsibility.” My objection centers on how our intuitions regarding crimes of passion conflict with the conclusions drawn by the deep-self view. I then proceed to sketch out three possible responses which can be made by an adherent to the deep-self view and make my recommendations on how such adherents should proceed in further understanding moral (...) responsibility. Although there is discussion among ethicists about the permissibility of actions on the antenatal placenta, these discussions rarely take seriously the metaphysics involved. Rather, authors resort to opinion on how the placenta comes to be and for whose good it exists. This paper takes these metaphysical questions seriously. Through discussion of the biology of the placenta, I conclude that it is a shared organ of the mother and the fetus. In an analogy to the ethics of conjoined twinning, I conclude (...) that actions on the placenta must take the good of both the mother and the fetus into account. (shrink)

Neo-Aristotelian ethical naturalism claims ethical goodness is a kind of human natural goodness, where natural goodness is a function of human nature. Call this the core thesis. The normativity objection claims the core thesis fails because ethical goodness is normative and natural goodness is not. In this study I aim to cast new light on this objection and propose a new strategy of response. My argument divides into two main moves. In the first, I side with critics in arguing that (...) Aristotelian naturalism has a serious problem that concerns the normativity of human nature, although standard formulations of the normativity objection do not quite capture it. The problem is that there is an explanatory gap in Aristotelian naturalism’s account of ethical goodness. I argue that although facts about human nature and natural goodness are irreducibly normative in the evaluative sense, they are not necessarily normative in the practical sense. Hence, Aristotelians need to explain what makes such facts practically normative. They have not successfully done this. This explanatory gap threatens the viability of Aristotelian naturalism, for it leaves a central feature of ethical experience—viz. the practical normativity of ethical facts—unexplained. I call this the normativity problem. In the second main move of my argument I propose a two-part solution to the normativity problem. The first part consists in a new metanormative account of the source of normativity I call Aristotelian constructivism. It yields an objectivist, species-relative and naturalistic account of practical normativity. The second part of the solution is an account of practical reason that connects human final ends with human nature. Aristotelian constructivism explains the practical normativity of those final ends, and thus of facts about human nature, without reference to the evaluative status of those facts. Aristotelian constructivism thereby enables Aristotelian naturalists to retain their core thesis. (shrink)

An exchange between Christopher Tollefsen and Steven Jensen highlights the contrast between a theory of natural law that relies purely first-person account of intention and one that relies more on elements from the physical world. Tollefsen, a proponent of New Natural Law theory, argues that the fetus’s death in the Phoenix case was an unintended side effect of saving the mother’s life. Jensen criticizes NNL generally and particularly for this conclusion. He argues that facts outside the agent make this procedure (...) immoral. This essay provides a more neutral perspective on the debate by laying out each argument clearly and identifying the fundamental issues present in the discussion. A fundamental and probably irreconcilable difference involves whether certain intentions should be included in the species of an action or characterized as fairly or unfairly accepted side effects. Nevertheless, the differences between these two accounts are not as great as they initially appear. (shrink)
